DISCLAIMER NOTICE CONDITIONS OF ENTRY & TERMS AND CONDITIONS FOR TICKET HOLDERS, COMPETITORS, VOLUNTEERS AND GENERAL MEMBERS OF THE PUBLIC

INTENDED FOR ENFORCEMENT DIRECTLY BEFORE, DURING AND DIRECTLY AFTER OUR EVENTS AT BEVERLEY RACE TRACK. (SEE REFERENCE **”SITE”) WHILE UNDER THE IMMEDIATE CONTROL OF THE WATPA  AS PER PRESCRIBED BY THE “SHIRE OF BEVERLEY” AND ONLY WARRANTS TO THIS TIME FRAME WHERE THE WATPA INC  HAVE LEGITIMATE ACCESS TO THIS VENUE.

LIMITATIONS OF LIABILITY

WATPA* and the Shire Of Beverley  WILL NOT BE LIABLE FOR PERSONAL INJURY OR PROPERTY DAMAGE.

Whereas * WATPA meaning “The Western Australian Tractor Pull Association Incorporated” Registration A1015559J Associations Incorporations ACT 1987  (section 9(1)) Western Australia Dept of Commerce.

 RIGHT OF REFUSAL: We the WATPA INC  do so reserve the right to- and undertake our duty in the interest of public safety to- “Refuse Admission” before or during the event and remove from the venue any individual/s whom “may endanger” “be intoxicated”-(to an extent whereas they cause harm, endanger or menace or nuisance to others)  or “cause harm to any other person or persons by way of negligence or deliberate menacing or to cause others endangerment”, either before or during an event and may be removed from the venue by forceful means if proven necessary by our licensed security staff, without refund and may also result in prosecution and damages claims being pursued against them.


REFUSAL TO SERVE ALCOHOL UNLESS PROOF OF AGE CAN BE SUPPLIED WITH COMPLIANT 18 + DOCUMENTS.

Entry into our designated licensed area may be refused for reasons such as drunkenness, disorderly behaviour, unacceptable dress, false or insufficient photo identification, or being under-age.

(PRIVACY NOTE: We maintain our right to copy the provided Identity materials/proof of age solely for “proof of compliancy” for the code “Liquor Control Act 1988” (as amended)).


YOUR REQUIREMENTS For Proof of age 

There are only three acceptable forms of photo ID (Section 126(2) LCA): 

current Australian Driver’s Licence with photograph.
current passport.
current Western Australian Proof of age card.

 WATPA INC CODE OF CONDUCT ALCOHOL SALES AND CONSUMPTION

  The sale of liquor and its consumption on our event premises is an essential part of our association’s revenue, management and staff are committed to operating the WATPA in accordance with the laws pertaining to the sale and supply of liquor at and from these premises.

  Management and Volunteer staff of the WATPA Inc recognise and acknowledge that the excessive, or irresponsible, consumption of liquor can be harmful to individuals and the community.

  Management and staff understand the importance of the responsible service of alcohol to enable our patrons to enjoy the facilities at our events in Beverley.

  It is not our intention to allow our patrons to consume liquor at the WATPA Inc event to an extent that it is harmful to themselves or harmful to others. Management and Volunteer staff are committed to serving alcohol to our patrons in a responsible manner in accordance with the guidelines published by the Director of Liquor Licensing.

  It is our responsibility as event licensees and the duty of our staff and crowd controllers to identify patrons who are consuming alcohol in excess or in an irresponsible manner.

  Management discourages the irresponsible or excessive consumption of alcohol by implementing strategies to prevent or reduce such activity on the part of our patrons.

  We encourage, and require, our patrons to consume alcohol in a responsible manner. Management will require any patron who consumes alcohol irresponsibly or behaves in a disorderly manner to leave our premises in an orderly fashion when requested to do so.

  We do not permit juveniles who are not accompanied by, or under the supervision of, a responsible adult to patronise our premises. The law in respect of juveniles will be enforced at all times.

  We the WATPA INC respect the rights of the Beverley Community, particularly neighbours living in close proximity of the WATPA Inc event site. Neighbours or are not to be unduly disturbed, or inconvenienced, as a result of any operation arising from our events. We expect and encourage our patrons to also respect the rights of our neighbours and town community by behaving in an appropriate manner whilst patronising and leaving our event premises and townsite.

Management and Volunteer staff are committed to addressing any complaint that may arise from our activities at the WATPA Inc event, or the behaviour of our patrons in the vicinity of the event site. We are committed to responding to, and resolving, any complaint in an expeditious, courteous and appropriate manner.

 

MOTOR SPORT IS EXTREMELY DANGEROUS – YOU the Ticket holder are fully aware and recognise that motor sport is inherently dangerous. Entry into and remaining at the Event controlled by WATPA  and the Shire of Beverley and other premises or property not under the control of WATPA  has a degree of danger and there is a possibility of an accident causing injury, death, property damage or other losses; and it is a condition of entry that the Ticket holder attending the Events enter the Site/s, and use the services and facilities of the Event entirely at their own risk.

The WATPA and or the Shire Of Beverley  WILL NOT BE HELD LIABLE FOR INJURY OR DAMAGES – To the extent permitted by law in WESTERN AUSTRALIA, the Ticket holder attending the Events hereby exclude WATPA and the Shire Of Beverley , the Crown in right of the State of Western Australia, and all other persons including corporations involved in the organisation, conduct, sponsorship and promotion of the Events and including the employees, officers and agents of all the aforementioned from being liable for any loss, damage or injury to person or property incurred directly or indirectly as a result of any motor accidents or any other events whatsoever including but not limited to loss, damage or injury to person or property occurring: at the EVENT/S from the use of the services and facilities at the event whether or not the same may be due or alleged to be due to negligence or misconduct on the part of the Ticket holder, a third party, or WATPA and the Shire Of Beverley ; and in an area not under the control of WATPA and the Shire Of Beverley  whether or not the same may be due or alleged to be due to negligence or misconduct on the part of the Ticket holder, a third party, or WATPA and the Shire Of Beverley.

PARENTS, CHILDREN ARE TO BE SUPERVISED AT ALL TIMES BY ADULTS – The Ticket holder acknowledges that all children attending the Events must be under the supervision of an adult guardian at all times. (Editor note: “PLEASE BRING EAR PROTECTION FOR YOUR CHILDREN”). Protective ear “plugs” for children can be purchased onsite from the office.

SOUND LEVELS will at times during the event exceed comfortable levels. 

We strongly ENCOURAGE the use of ear protection 

ESPECIALLY  your childrens hearing… Please dont risk their future.

By way of purchasing a ticket, competing in an event, as a volunteer or any member what-so-ever of the public, you are seen to be observing and are presumed to have taken notice by way of discovering the WATPA “CONDITIONS OF ENTRY” and or “TERMS AND CONDITIONS” – To our Events and Site**.

 Please note these words. (“WARNING TO THE PUBLIC”) They are printed on your ticket and Event Programs handed to you at the gate upon entry and as per sign posted and is written below, please read down..

You have been warned of these entry conditions and by entering our events you acknowledge and understand your obligation to observe caution at all times as you agree by way of entering our facilities that  the onus for any injuries, losses or damages rests-  SOLELY UPON YOU.

WARNING TO THE PUBLIC

MOTORSPORT IS DANGEROUS and spectators attending this venue do so entirely at their own risk. It is a condition of admission that all persons having a connection with the promotion and/or organisation and/or conduct of the meeting, including the owners of the land and owners of the vehicle and passengers in the vehicles, are absolved from all liability arising out of any accidents causing damage or personal injury or death to spectators or ticket holders, except where due care and skill has not been exercised. Vehicles are permitted to enter the venue and park on the condition that WATPA and the Shire Of Beverley are not under any liability whether contract or in tort and whether for negligence or as an occupier or on any other basis or for any cause of action, for loss of, or damage to, the vehicle or its contents no matter where such may be caused.

 EXCLUSIVE LICENCING ARRANGEMENTS WITH THE WATPA PRIOR TO ANY MATTER BEING DISTRIBUTED MUST BE MET.

Access control technological protection measures may be enforced. At our discretion any  “infringing copy” will held accountable to the full-force of the relevant Law/s.
